Terms of Service — Fondasyon

Welcome to Fondasyon ("Fondasyon," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, donation platform, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Who We Are

Fondasyon is a diaspora-powered platform that connects donors with vetted community projects in Haiti. We facilitate donations from supporters to project organizers; we are not the operator of the underlying projects unless explicitly stated.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or make a donation. By using the Services you represent that all information you provide is accurate and that you have the legal authority to enter into these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
You agree to notify us immediately of any unauthorized use of your account.

4. Donations

Donations made through Fondasyon are processed by our payment provider, Stripe. Donations are voluntary contributions to the listed project. Please review our Donation & Refund Policy for details on how donations are handled.

5. Organizer Responsibilities

If you submit a project as an organizer you agree to:

Provide accurate information about yourself, your project, and your funding goals.
Use funds raised for the stated project purpose.
Post timely progress updates so donors can follow the impact of their contribution.
Cooperate with our vetting and review process.

6. Prohibited Conduct

You agree not to:

Submit false, misleading, or fraudulent project information.
Use the Services for money laundering, terrorism financing, or any illegal purpose.
Infringe the intellectual property or privacy rights of others.
Attempt to gain unauthorized access to any portion of the Services.

7. Content

You retain ownership of content you post (project descriptions, photos, updates). You grant Fondasyon a worldwide, non-exclusive, royalty-free license to host, display, and promote that content as part of operating the Services.

8. Vetting and Removal

We review projects for legitimacy and feasibility but do not guarantee outcomes. We may approve, reject, suspend, or remove any project or account at our discretion, including for breach of these Terms or risk to donors.

9. Fees

Fondasyon may deduct payment processing fees charged by Stripe from each donation. Any additional platform fees will be disclosed prior to checkout.

10. Disclaimers

The Services are provided "as is" without warranties of any kind. We do not guarantee that a funded project will be completed or that any specific outcome will result from your donation.

11. Limitation of Liability

To the maximum extent permitted by law, Fondasyon and its team will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid through the Services in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Fondasyon from any claims, losses, or expenses arising from your breach of these Terms, your content, or your use of the Services.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Fondasyon is established, without regard to its conflict of laws principles.
